An Exparte or a full order of protection seeks an order protecting an individual from physical abuse, physical threats, stalking or harassment. Additionally, if it involves a family member, the Court may grant orders affecting numerous other rights of parties. This includes child custody, child support, maintenance (alimony) and property possession. RSMO Section 455.045 Given the vast array of relief that may be granted by the Court, and the fast-moving nature of the proceedings, having an attorney assist with your order of protection can be beneficial to the outcome of your case.
An order of protection may have significant impacts on a person’s future. The entry of an order of protection can impact a Respondent’s employment and housing prospects immediately. Entry of an order may also prevent the ownership and/or possession of fire arms by the Respondent. The violation of an order of protection is a also a criminal offense, subject to jail and fines. Defending against an order of protection successfully can affect an individual’s finances and living arrangements for the remainder of his or her life.
Hiring an attorney can make the difference in a full order of protection being granted or not. Attempting to represent yourself can have dire consequences in that an individual has no knowledge of the rules of evidence and how to lay foundations to get evidence in to evidence or to keep them out.
The law office of Rita Sanders has handled numerous exparte cases successfully. Give us a call to discuss your case today!
Limited and drivers License Reinstatements:
If you’ve received notice a of driver’s license suspension, don’t panic. There are ways to still be able to drive legally.
Many people lose their driving privileges for both minor and major offenses. At the Law Office of Rita Sanders we have helped hundreds of people in your same situation.
We are dedicated to working with clients who are looking to have their driving privileges restored.
If your driver’s license has been suspended or revoked for a period of five or ten years, you have the right to petition the court to reinstate it. Depending on your circumstances, there are different ways to go about this.
Reasons for a License Suspension:
There are a number of reasons a driver could have their driver’s licenses suspended or revoked.
Here are the majority of reasons:
Point Accumulation. In Missouri, if you accumulate eight points in 18 months, your driving privileges will be suspended. A first suspension is 30 days, a second is 60 days, and a third is 90 days. If a driver accumulates 12 points in 12 months, 18 points in 24 months, or 24 points in 36 months, the driver will lose their license for a year and be required to retake the driver exam.
Points can accumulate through things like speeding, reckless driving, or ignoring traffic laws.
Numerous Offenses. If a driver is found to be repeating violations, like speeding, they could lose their license for a significant period of time.
Criminal Convictions. Serious offenses that lead to license suspension include driving under the influence (DUI), driving while intoxicated (DWI), felonies, vehicular manslaughter or homicide, leaving the scene of an accident (hit-and-run), and fleeing or evading law enforcement officer.
No Insurance. A driver who is caught without auto insurance or even proof of auto insurance could lose their license for a period of time.
If you find yourself to be in a different situation than what we’ve discussed, that does not mean you do not have legal options. Our lawyers will be able to determine what your rights are.
Reinstatement Requirements:
According to the Missouri Department of Revenue, if your license has been revoked for a a period of five or ten years you have the right to file a petition to request that the court reinstate it.
The law Office of Rita Sanders has been assisting clients for over 23 years in getting both fully reinstated and in getting limited driving permits. We can file the petition in the country where you obtained the offense that resulted in you suspension or revocation. Once the petition is filed you will need to get a Criminal History Check. This requires a four-digital fingerprint registration number. After you’ve obtained that, you can register with the Missouri Automated Criminal History Site (MACHS) so that the Criminal History Check can be performed.
While these steps can be a bit overwhelming for an individual, having our office help you makes the process much less stressful.
Limited Driving Privileges:
If you find that you are not eligible for full reinstatement, but you need to drive to places such as for employment, medical appointments, school, etc. you may be eligible for a Limited Driving Privilege (LDP), also referred to as a “hardship license.” If the Limited Permit is granted, you will be able to drive to specific, pre-approved locations. Also keep in mind, this type of license cannot be used to drive commercial motor vehicles.
WAYS TO RECEIVE A LIMITED PERMIT:
There are basically two ways to apply for your limited driving permit:
If your license has been revoked for a period of fewer than five years, we can submit an application to the Department of Revenue. If your license has been revoked for five or ten years, we will need to file a petition with the circuit court in the county where you work or live.
There are several steps you must complete in order for the Court to grant the petition.
You must Pay the court filing fees for the petition.
you must have SR-22 or high risk insurance.
If your license is revoked due to two or more alcohol related an offenses you will have to have an ignition interlock system installed in your vehicle.
*Our office is dedicated to helping make this process as easy as possible for you.
