Expungements
We can now petition the courts to expunge old criminal convictions under a Missouri expungement bill.
Expungement Facts:
- Not all crimes in Missouri can be expunged under the new statute
- The petition must be filed in the court or county where you were charged or found guilty of the offenses.
- All law enforcement agencies must be named and served in the petitions. Any agency that may hold criminal records. (Municipal court, circuit court, FBI, Homeland Security, MO State Highway Patrol, Local Sheriff, Dept of Revenue.)
- The state and agency’s have 30 days to file objections and hold a hearing within 60 days following the objections or 30 days after filing if no objections.
- There are periods of time after the conviction that you must wait to expunge. 7 years for a felony, 3 years for misdemeanors (Some cases may be expunged quicker.) DWI’s must wait 10 years to be expunged.
- Class A felonies, dangerous felonies as defined in RSMO 556-061, any offense requiring sex offender registration, felonies where deaths occur, nor any domestic assaults or kidnapping charges can be expunged.
Criminal arrests cannot be expunged before 3 years.
